Below is a list of most current updates and reminders of various events codes, as well as any applicable effective date(s).  

New Event Code for Attorneys:  Effective date:  11/20/08  -    Notice of Sale of Estate Property (LBR 6004-2)

This new event has been created to assist attorneys with the filing of Notice of Sale of Estate Property under Local Bankruptcy Rule 6004-2 on behalf of a debtor in possession.  It is located in CM/ECF under Bankruptcy > BK - Notice > Notice of Sale of Estate Property (LBR 6004-2).  NOTE:  This event code is not to be confused with event code Notice of Proposed Use, Sale or Lease of Property.

Reminder re:  Motion/Application To Set Property Value

When filing motions  to assess/or set the property value, all attorneys should use event code located in CM/ECF under Bankruptcy > Motions/Applications> Setting Property Value (motion).  

TRUSTEE and US TRUSTEES

Modified Events for Trustees and US Trustee:   Effective date:  11/20/08

Notice of Sale of Estate Property (LBR 6004-2)

This event has been modified to include information regarding the applicable Local Bankruptcy Rule 6004-2.  The event code remains under Bankruptcy > BK - Trustee/US Trustee> Notice of Sale of Estate Property (LBR 6004-2) and under Bankruptcy > US Trustee Only> Notice of Sale of Estate Property (LBR 6004-2)

Reminder re:  Motion/Application To Determine Value of Property

To file motions to determine the value of property, all trustees should use event code located under Bankruptcy > Motions/Applications> Determine Value of Property (motion).

Weird notice from Bankruptcy Noticing Center.

To further support Judiciary privacy policies, the Bankruptcy Noticing Center is pleased to offer increased security  of sensitive information contained in bankruptcy notices. Effective December 1, 2008, notice files transmitted to EBN subscribers as Adobe Portable Document Format (PDF) attachments will be encrypted and EBN subscribers will need a password to decrypt and view notices. Here are the functional highlights of the new security program:


   1. EBN Subscribers may create their own passwords online.  You will need to provide the following information  exactly:
      EBN Subscriber Email address:
      Subscriber Name:
      Go to http://ebn.uscourts.gov/register/pdf_encrypt.adp


   2. Passwords will not expire. Subscribers may request that  forgotten passwords be resent to the registered email address.


   3. When a PDF file is opened, the subscriber will be prompted  for his/her password.


   4. Every time a notice file is opened, the subscriber will be  prompted for the password, even if the file is saved to  another storage location.  It is the subscriber's  responsibility to safeguard his/her password. 


As an alternative, consider using the secure Email Link service. The Email Link service transmits to subscribers emails containing links to retrieve notices through the user's web browser.  Due to built-in security features, no password is required to use this service.

Notice regarding joint status reports (Santa Ana).

This notice is from the judges in Santa Ana.

"Notice to Practitioners, Santa Ana Division

Regarding Requirement for Timely Filing of Status Conference Reports in Adversary Proceedings and Imposition of Sanctions

The Judges of the Santa Ana Division have noticed a steady increase in the number of parties failing to file either timely or at all the status conference reports required under Local Bankruptcy Rule 7016-1(a)(2).  The Rule requires a filing of the status conference report at least 14 days before the status conference and provides for imposition of sanctions under Local Rule 7016-1(f) for noncompliance. Until now the Judges have merely exhorted practitioners to remember the Rule and have threatened imposition of sanctions for non-compliance, but have rarely actually imposed sanctions.  However, these measures appear to have been ineffective. Failure to abide by the Rule severely interferes with the processes of the Court and last-minute filing of status conference reports imposes an undue burden on the Court and its staff.   Therefore, please take notice that commencing January 2009 sanctions will be imposed as the rule rather than the exception for failure to comply with Local Rule 7016-1."
